Usually, bus and public transportation injuries would involve suing a governmental agency which also has a shorter short statute of limitations. It is very important that if you are injured by a City, State, or other Governmental Agency, that you contact us immediately so we can explain your rights.
Person Hit & Killed by Cal-Train
A person was struck and killed by a train at the Santa Clara Station on July 22, 2023, restricting rail service in the area, Caltrain said. Southbound train 630, carrying 12 passengers, struck a person at the station in Santa Clara about 10:59 a.m., Caltrain spokesperson Tasha Bartholomew said in a statement. No one on the train was injured. Emergency personnel are on scene and train service is currently stopped at the area. The death marks Caltrain's sixth fatality of the year. Dealing With Government Claims Can Be Complex This is a prime illustration of a Governmental Claim. In nearly all circumstances in California, if you sustain injuries caused by a State Employee or a local municipality such as The City of Pittsburg, City of Walnut Creek, or City of Brentwood, you must file a Claim Form with the appropriate agency within six months. Once the claim is rejected or deemed rejected by statute, you have the option to initiate a lawsuit in the relevant county. At the Henderson Law Firm, we have handled dozens of Governmental Claims, and one noteworthy case involved a woman who suffered leg injuries at a City Park due to hidden holes in the grass, concealed by overgrown vegetation. This particular case posed significant challenges due to the legal protections that governmental agencies typically have. However, through meticulous work and dedication, attorney Jill Stern-Henderson of the Henderson Law Firm was able to secure a six-figure resolution for the injuries sustained, leveraging very specific set of facts surrounding the incident. Dealing with Governmental Claims can be complex, but having experienced legal representation can make a critical difference in pursuing just compensation for injuries caused by the negligence of government entities.
